Terms and conditions for general public.
The terms and conditions contained in this document are intended to establish the conditions which apply to the use and access of the medmesafe intermediation platform (hereinafter the "platform") by Individuals who are registered as users on the platform which is operated by PROMETUM SPAIN, S.L.U., (hereinafter "medmesafe"), tax identification number (NIF) B87614269, registered office at calle Zurbano nº 92 (6º Dcha), 28003 Madrid, Spain, and address for notification purposes at calle Zurbano nº 92 (6º Dcha), 28003 Madrid, Spain, registered in the Commercial Register of Madrid in Volume 35024, Folio 110, Section 8, Sheet M-629889, Entry 1.
Registration on the platform allows the Individual or registered user to access and engage the services provided by third-party service providers through the medmesafe platform.
Third-party service providers who act through medmesafe consist of medical professionals or practitioners (who provide services such as prescription, reading and interpreting of results reports and advice, if requested by the Individuals) and laboratories (which perform the analyses requested by the Individuals as well as send the results reports).
The condition of the Individual is obtained through the completion and submission of a registration form for Individuals by the user which is available on the platform.
The Individual is aware that they are solely and exclusively responsible for their registration and use of the services offered through the platform. In addition, the Individual is obliged to use the offered services exclusively for private purposes and/or on the basis of the legal relationship linking them to the third parties who provide their services through the medmesafe platform. This excludes any type of subsequent use of such services for profit. Otherwise, the Individual must report any kind of benefit, direct or indirect.
If these terms and conditions are replaced by others, in whole or in part, these updated terms and conditions must be accepted in an identical manner to the ones previously accepted.
In the event the Individual does not accept these terms and conditions, they must refrain from registering on the platform and must leave the platform.
B) REQUIREMENTS FOR THE USE OF THE SERVICES OFFERED THROUGH THE PLATFORM
To procure and use the services offered by the third-party service providers acting through the platform, the Individual must be a registered user, must have a medical prescription, must assign a professional to their file or record and must provide any personal and family medical history which is required during the procurement process.
Users register on the platform by completing the registration form. Once the registration form has been completed, the Individual will receive a confirmation email to verify their identity and to confirm that they actually intend to register as a user on the platform.
Once registered, the Individual can access the platform by entering their email address as the login and their chosen password. This will give them access to a private area where they can amend their data and add the information needed to generate their file or record. This is also where the results of the analysis requested by the Individual will be stored.
The Individual shall be responsible for the security of the passwords required to access the platform and is obliged to keep their user name and password safe. In addition, the Individual must notify medmesafe immediately of any non-consensual use of the platform.
In this case, the professional advising the Individual may pre-register them on the platform at their request.
This process is the same as the user registration process with the exception that in this case, the MMS professional is already assigned to the Individual in order for them to be able to access the Individual's file or record.
As in the previous case, the Individual will receive a confirmation email to verify their identity and to confirm that they actually intend to register as a user on the platform. The email will also contain information on the professional who pre-registered them and who is assigned to their file or record as well as on the product which has been prescribed to them.
To complete the registration process, the Individual must access the URL contained in the confirmation email and follow the registration steps.
Registration of Third Parties:
The Individual will have access to a screen where they can register a third person for whom they can request a service.
In this case, the Individual must provide the corresponding authorisation, duly completed and signed. For this, the Individual may use the Authorisation for application for registration and analysis on behalf of a third party and the Authorisation for the application for registration and analysis of minors by parents or guardians.
In their private area, the Individual can view a list of all the third parties they have registered. On this screen, the Individual can amend the details of the selected third party, deregister the selected third party and procure a service for the selected third party.
Assignment of a Professional:
Once registered, the Individual may assign a professional who has been accredited by medmesafe's Technical Committee and who is registered on the platform to their file or record. Once the professional has been assigned, they are in charge of the Individual's record. As a result, they can access the information contained within the record and prescribe the most appropriate analysis in view of the data provided by the Individual, as well as inform them of the results of the analysis.
Therefore, if the Individual wishes to receive advisory or telecare services in relation to the results of the requested analysis which are offered by the professionals through the platform, they must assign an MMS professional to their file as well as complete and sign the letter of authorisation and provision of informed consent in order for the professional to be able to process their personal genetic data which is supplied at the time of delivery of the sample collection kit or at the time of extraction, as the case may be.
In order to procure the analysis services offered by the laboratories through the platform, the Individual must have a prescription issued by the appropriate professional, whether this is a professional who is registered on the platform or an external professional. In the second case, the system will prompt the Individual during the procurement process to provide the document or file containing the medical prescription. If the Individual does not have a medical prescription, they can request information on the steps required to obtain one through the platform.
Once an analysis has been prescribed by a professional registered on the platform, the Individual will receive an email containing the details of the prescribing doctor or practitioner as well as the prescribed analysis. The email will also contain a link which can be used to directly access the procurement process. Furthermore, an online notification will appear in the Individual's private area, informing them that they have a prescription. In this zone, the Individual will have access to a screen which contains the list of the prescriptions which have been made. On this screen, the Individual can view the following information.
- Date of the prescription.
- Date of the procurement of the service.
- Name of the analysis.
- Prescribing professional.
- Prescription status (service requested or not).
Prior to procuring an analysis service, the Individual must provide any personal and family medical history which is required to ensure the analysis is performed correctly. Once accepted, the service shall be procured in accordance with the terms provided in the Special Conditions of Contract, which must be accepted by the Individual for such purposes.
C) DEREGISTRATION OF A USER
The Individual may cancel their account at any time using the mechanism offered on the platform for such purpose. In this case, the system will send the Individual a message explaining the cancellation process and the consequences of such. The message will also specify the period during which the Individual may download any information they had stored on the platform. Once this period has elapsed, and at the request of the Individual, the account will be terminated and the information deleted.
